1. Introduction

AndeKarate.com ("we," "our," or "the Website") respects the intellectual property rights of others and expects our users to do the same. 2. What is the DMCA?

3. Reporting Copyright Infringement (Takedown Notice)

A valid DMCA takedown notice MUST include the following six elements:

  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

    • For example: "The infringing content is the egg price table for Delhi-NCR published on the page URL: [Insert Exact URL of the page]."

  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Submit Your Takedown Notice to Our Designated Agent

5. Counter-Notification Procedure

If you believe that your content was removed (or access to it was disabled) as a result of a mistake or misidentification, you may send us a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA.

A valid counter-notification MUST include:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.

  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction in India), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. The original complainant then has 10 business days to notify us that they have filed a court action relating to the material. If we do not receive such notification, we may restore the material.

6. False Claims

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We may disclose your notice to the alleged infringer and publish it in place of disabled content.

7. Repeat Infringers

It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who are repeat infringers of intellectual property rights.
